The Panel surveyed the state of fulfillment of terms of contract directly at the enterprise. The Panel listened to the report on the said issue presented by relevant departments.
Thus, the report on current supervision over fulfillment of purchase contracts for holdings of shares of Mittal Steel Kryvyi Rih JSK conducted by the State Property Fund of Ukraine on 24-28 March 2008 states that 4 clauses of the contractual terms out of 57 failed to be fulfilled. However, the purchaser failed to agree with the conclusions of the State Property Fund.
In order to coordinate the positions of the contractual parties, on 8-12 September 2008, the State Property Fund of Ukraine conducted supervision over fulfillment of terms of purchase contract for holdings of shares of Mittal Steel Kryvyi Rih JSK with attendance of the representatives of public authorities and experts.
The People´s Deputies headed by Ye.V.Marmazov, Head of the Special Supervisory Panel on Privatization, surveyed the situation directly at the enterprise.
The supervisors did not establish any facts of violation of contractual terms.
The Panel passed a resolution, pursuant to which, "supervision of the State Property Fund of Ukraine over purchaser´s fulfillment of terms of purchase contract for holdings of shares of Mittal Steel Kryvyi Rih JSK was biased and preconceived".
